Terms of Service

These Terms of Service ("Terms") govern your use of VenuRate, operated by Estranho ("we," "us," or "our"). By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. Eligibility

You must be at least 13 years old to use VenuRate. By using the Service, you represent that you meet this requirement. If you are between 13 and 18, you represent that a parent or guardian has reviewed and agreed to these Terms on your behalf.

2. Account Responsibilities

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to notify us immediately of any unauthorized use at VenuRate@estranho.net. We are not liable for any loss resulting from unauthorized use of your account.

3. User-Generated Content

VenuRate allows users to submit venue listings, reviews, ratings, and photos ("User Content"). By submitting User Content, you:

• Represent that you have the right to submit it and that it does not violate any third-party rights.
• Grant Estranho a non-exclusive, royalty-free, worldwide, irrevocable license to display, distribute, and use your User Content to operate and promote the Service. This license survives account deletion with respect to content that has been publicly displayed, though you may request removal of your specific contributions by contacting us.
• Understand that your display name will be shown publicly alongside your contributions.

You retain ownership of your User Content. We do not claim ownership of what you submit.

4. Content Standards

You agree not to submit User Content that:

• Is false, misleading, or fraudulent.
• Is defamatory, harassing, threatening, or abusive.
• Contains hate speech or discriminatory language.
• Violates any person's privacy or publicity rights.
• Infringes any copyright, trademark, or other intellectual property right.
• Contains nudity, sexually explicit material, or graphic violence.
• Constitutes spam or unsolicited commercial content.
• Violates any applicable law or regulation.

5. Content Moderation

We reserve the right — but not the obligation — to review, moderate, edit, or remove any User Content at our sole discretion, at any time, without notice. We are not responsible for User Content submitted by other users. If you encounter content that violates these Terms, please report it to VenuRate@estranho.net.

We are not liable for any User Content posted on the Service, including content that is inaccurate, offensive, or that you find objectionable. Use of the Service and reliance on User Content is at your own risk.

6. Venue Information Accuracy

Venue listings, schedules, and meet information on VenuRate are submitted by users and may not be accurate, complete, or up to date. We make no warranties about the accuracy of any venue information. Always verify directly with the venue or organization before traveling or making decisions based on information found on VenuRate.

7. Account Termination

We reserve the right to suspend or terminate your account at any time, with or without notice, for violation of these Terms or for any other reason at our discretion. You may delete your account at any time by contacting us at VenuRate@estranho.net.

8. Intellectual Property

The VenuRate name, logo, and all software, design, and original content created by Estranho are the property of Estranho and are protected by applicable intellectual property laws. You may not copy, modify, or redistribute them without our written permission.

9. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.

10. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY INDIANA LAW, ESTRANHO SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY TO YOU FOR ANY CLAIM SHALL NOT EXCEED FIFTY DOLLARS ($50).

11. Governing Law

These Terms are governed by the laws of the State of Indiana, without regard to its conflict of law provisions. Any disputes shall be resolved in the state or federal courts located in Indiana, and you consent to the personal jurisdiction of such courts.

12. Changes to These Terms

We may update these Terms from time to time. We will notify registered users of material changes via email. Continued use of the Service after the effective date of any changes constitutes acceptance of the updated Terms.
